Forced Organ Harvesting in China: What Has Actually Been Established, and What Remains Contested?

Few allegations involving China are as grave as the claim that prisoners of conscience have been killed so their organs could be used for transplantation.

It is also precisely the kind of subject on which journalism must resist two temptations: sensationalism on one side and dismissal without examining the evidence on the other.

The strongest way to approach the issue is not by asking readers to accept what Falun Gong practitioners say. It is to examine what international institutions, independent investigators and governments have actually put on record.

What is Falun Dafa?

Falun Dafa, also known as Falun Gong, is a spiritual practice combining five meditative exercises with teachings centred on Truthfulness, Compassion and Forbearance. It became widely practised in China during the 1990s before the Chinese Communist Party launched a nationwide campaign against it in July 1999. This history matters because Falun Gong practitioners subsequently became one of the populations at the centre of allegations concerning China's transplantation system.

What have United Nations experts said?

The European Parliament's 2022 resolution records that UN human-rights experts received what they described as credible information that detainees from ethnic, linguistic or religious minorities in China had been subjected without consent to blood tests, ultrasounds, X-rays and other examinations capable of assessing organ compatibility.

Those groups included Falun Gong practitioners and other minorities.

The same resolution notes that UN experts had previously raised organ-harvesting concerns with Beijing in 2006 and 2007 and found China's responses lacking sufficient information about organ sources to resolve those concerns. European Parliament

That wording is important.

The UN experts did not issue a criminal conviction against China. They said credible information warranted concern and requested independent monitoring and transparency.

What did the China Tribunal conclude?

An independent people's tribunal chaired by Sir Geoffrey Nice, who previously prosecuted Slobodan Milošević at the International Criminal Tribunal for the former Yugoslavia, examined evidence concerning forced organ harvesting in China.

The European Parliament's 2022 resolution records the tribunal's conclusion that forced organ harvesting had occurred for years on a significant scale and that Falun Gong practitioners had probably been the principal source of organs.

This, too, needs precise description.

The China Tribunal was an independent tribunal, not a court created by the United Nations or an international treaty body. Its conclusions therefore carry a different legal status from a criminal judgment issued by a national or international court.

But its evidence and findings have subsequently been cited by legislatures and policymakers.

What does the European Parliament say?

In May 2022, the European Parliament adopted a resolution expressing serious concern about reports of persistent, systematic, inhumane and state-sanctioned organ harvesting from prisoners in China.

The resolution specifically addressed Falun Gong practitioners and other minorities.

It called on Chinese authorities to respond to allegations concerning organ harvesting, allow independent monitoring and ensure transparency over organ sources.

And what does Beijing say?

China has repeatedly and categorically denied allegations that Falun Gong practitioners have been killed for their organs.

The European Parliament's resolution explicitly records that denial.

China also says it stopped sourcing organs from executed prisoners in 2015 and shifted to a voluntary donation system.

International critics argue that transparency and traceability remain insufficient to independently verify the origin of all transplanted organs. The European Parliament's resolution specifically states that China's transplant system does not meet expected transparency and traceability standards and that Beijing has resisted independent scrutiny.

Why should India care?

India has its own transplant system, medical ethics framework and concerns about organ trafficking and transplant tourism.

That makes this more than a distant human-rights question.

If Indian patients travel to another jurisdiction for transplantation, Indian doctors, hospitals and regulators have a legitimate interest in understanding whether organs can be independently traced to voluntary and informed donors.

The correct journalistic question is therefore not:

“Do you believe Falun Gong?”

It is:

Can China provide independently verifiable evidence demonstrating where its transplant organs come from?

That is a question medical journalists, transplant surgeons and governments are entitled to ask irrespective of ideology.

And if China's government objects to Falun Gong-linked journalists raising such questions during international visits, that only makes rigorous scrutiny more, not less, necessary.
